BYLAW AMENDMENT / REGULATION OF LEAD PIPE IN
RESIDENTIAL AND COMMERCIAL HOUSING
Warrant Article Text:
To see if the Town will vote to amend Title V of the Town Bylaws
by adding a new section to require that prior to the sale, of a
residential or commercial property, a property owner will be
obligated to obtain a certificate that the water supplied to the
property is by a lead free water line from the Town valve to the
property’s water meter; or take any action related thereto.

COMMENT: The Board voted unanimously that no action be
taken on this article.
This proposed article sought to amend the Town Bylaws to
require residential property owners, at the time of sale of that
residential property, to certify that the property is serviced by a
lead-free water line from the point of the valve on town owned
property to the property’s water meter. One of the outlined
objectives of the proposed bylaw amendment is to further the
town’s ongoing efforts to comply with the Massachusetts
Department of Environmental Protection DEP) and Environmental
Protection Agency’s (EPA) Lead and Copper Rule Improvements
(LCRI) law and regulations regarding lead water lines.

The Board expressed strong support for Public Works’ ongoing
efforts to identify and eliminate lead water lines in town and
encourages and supports ongoing attempts to address this
important issue. Given that the number of potential private
properties that could have lead pipes is less than 650, and since
full compliance with the LCRI regulations is not required until
2034, the Board questioned whether a bylaw amendment
applying to all properties in Town was necessary at this time.
Following the hearing, the Town’s DPW Director, the proponent of
the article, requested that the Board recommend no action.
